Refund Policy 환불 정책

1.1 What this Policy covers

This Policy applies to purchases of Phazic software licenses and related digital products (collectively, the "Products") from Devign29, a sole proprietorship registered in the Republic of Korea ("Devign29," "we," "our," or "us"), made through the www.phazic.com website and its authorized checkout.

1.2 Merchant of Record

For self-serve orders placed through the site checkout, Devign29 sells through Paddle.com as the Merchant of Record; quoted and domestic orders are sold directly by Devign29 (see Section 1.4). Where Paddle is the Merchant of Record, this affects how invoices are issued and how refunds are processed; see Section 8 for details.

1.3 Relationship to other terms

This Policy supplements, and should be read together with, the Website Terms of Use, the Software End User License Agreement ("EULA"), and the Privacy Policy available on the Site. In case of conflict regarding refunds, this Policy controls.

1.4 Which channel your order used

How a refund is handled depends on how the order was placed:

• Self-serve orders (listed editions bought through the site checkout) are sold through Paddle as Merchant of Record. This Policy applies in full and refunds, where due, are processed by Paddle to the original payment method (Sections 7 and 8).
• Quoted orders (team, floating, site, and volume licences) are sold directly by Devign29 against a purchase order and invoice, settled by bank transfer; Paddle is not involved. Refunds for these orders are governed by the applicable quotation or licence agreement. Because these are node-locked licences delivered electronically, they are generally non-refundable once the licence has been delivered, except for a defective or non-conforming licence (Section 5), a duplicate or erroneous charge (Section 6), or a statutory right that applies where the buyer is a Consumer (Section 4). Any refund that is due is paid by Devign29 by bank transfer.
• Domestic orders (Republic of Korea) are sold directly by Devign29 with a Korean tax invoice (세금계산서); Paddle is not involved. The Korean statutory withdrawal rules in Section 4.3 apply, and any refund that is due is paid by Devign29.

References in this Policy to Paddle processing payments or refunds apply to self-serve orders. For quoted and domestic orders, read those references as Devign29 acting directly.

2.1 Digital software

The Products are digital software: license keys and/or activation entitlements delivered electronically. There is no physical shipment of any tangible medium.

2.2 Completion of delivery

Delivery is deemed complete upon issuance of the license key or activation of the entitlement, whichever occurs first. From that point, the Product is available for immediate use.

A fully functional demo of Phazic is available free of charge. We strongly encourage every customer to evaluate the demo — against their own materials, wavelength ranges, and accuracy requirements — before purchasing. The demo runs the same solvers and workflows as a paid license (subject to the published demo limits), so You can confirm Phazic fits Your needs before You pay.

Because a free evaluation is available and paid licenses are delivered and usable immediately, purchases are non-refundable once the license key has been delivered or the Software has been activated, except:

• Your statutory withdrawal / cancellation rights (Section 4), which apply according to Your country of residence and are administered by Paddle as Merchant of Record;
• a defective or materially non-conforming license (Section 5); or
• a duplicate or erroneous charge (Section 6).

Annual subscriptions. You may cancel at any time from the Paddle receipt / customer portal or by contacting support (Section 7). Cancellation stops all future renewals and You keep access until the end of the period already paid for; it does not by itself entitle You to a refund of the current period, subject to Your statutory rights.

Devign29 does not itself offer discretionary refunds for change of mind, buyer's remorse, lack of use, or insufficient hardware after purchase. Any discretionary refund is granted, if at all, solely by Paddle under Paddle's Refund Policy (Section 8). This Section states the general rule; Section 4 states the separate statutory rights available to Consumers.

4.1 Consumers only; business purchases

The statutory withdrawal and cancellation carve-outs in this Section 4 apply only where the buyer is a Consumer (a natural person acting wholly or mainly outside that person's trade, business, craft, or profession) and applicable mandatory law grants such a right. Where such a right applies, it prevails over Section 3. For business or B2B purchases, all sales are unconditionally final: no statutory cooling-off or withdrawal right exists for businesses under EU, UK, or Korean law, and Section 3 applies in full. Nothing in this Policy limits or excludes any statutory right that cannot lawfully be limited or excluded.

4.2 EU and UK Consumers — digital content and loss of the 14-day right

For a Consumer in the EU or UK, the 14-day right of withdrawal for digital content may be lost once download or activation of the digital content has begun with the Consumer's prior express consent and acknowledgement that the right is thereby lost. That prior express consent to immediate performance, and the acknowledgement that the right of withdrawal is thereby lost, are obtained at the Paddle checkout and confirmed on a durable medium in the Paddle order confirmation or receipt (Consumer Rights Directive Art. 8(7); UK Consumer Contracts Regulations 2013 regs. 12(5) and 16(3)), so that the immediate-delivery waiver in Section 3 is effective. Where those conditions are met and performance then begins, the 14-day statutory right of withdrawal is no longer available.

4.3 Korean Consumers — 전자상거래법 § 17

For a Consumer resident in the Republic of Korea, the EU/UK "consent and acknowledgement" rule in Section 4.2 does not apply; the Act on the Consumer Protection in Electronic Commerce ("전자상거래법") governs. Under 전자상거래법 § 17, a Korean Consumer's 7-day right of subscription withdrawal (청약철회) for digital content may be excluded only where Devign29 both (i) clearly indicates in advance that withdrawal is unavailable and (ii) provides a means of trial use (시험 사용). Devign29 satisfies condition (ii) by offering a free, time-limited trial of the full Phazic Suite (all modules and features enabled; a 10-day evaluation period, extendable on request) as the statutory trial-use measure under Enforcement Decree § 21-2. Where both conditions are met, the 7-day 청약철회 right does not apply once download or activation of the paid licence has begun.

Separately, if the software differs from its advertising or the description under which it was supplied, the Korean Consumer may withdraw within 3 months from the date of supply, or within 30 days from the date the Consumer became or could have become aware of the non-conformity, whichever applies.

4.4 Refund timing for statutory withdrawals

Where a Consumer validly exercises a statutory right of withdrawal or cancellation under this Section 4, the amount paid will be refunded to the original payment method within 14 days of the withdrawal taking effect, processed by Paddle as set out in Sections 7 and 8.

4.5 No limitation of non-excludable rights

Nothing in this Policy limits any non-excludable statutory right that applies to Your purchase under the mandatory law of Your habitual residence.

If the software is not in conformity with the EULA or its published documentation (applying the subjective and objective conformity criteria of Directive (EU) 2019/770 on the supply of digital content), the buyer may require Devign29 to bring it into conformity by repair or replacement, or by providing a working license, within a reasonable period and without significant inconvenience. In addition, the buyer may be entitled to a proportionate price reduction, or a refund of the amount paid for the affected license, and to immediate termination of the contract where the lack of conformity is serious or where repair or replacement has failed, is impossible, or would be disproportionate. Devign29 will also provide the updates necessary to keep the software in conformity for the period the buyer may reasonably expect. Devign29 may first ask for reasonable information to reproduce and diagnose the issue.

Duplicate charges, incorrect amounts, or charges for a Product that was never delivered will be refunded upon verification. Please contact us as set out in Section 7 with the relevant transaction details so that we can verify and correct the charge.

7.1 Where to send Your request

Email support@devign29.com with:

• the order or transaction ID;
• the email address used for the purchase;
• the reason for the refund request; and
• the Paddle transaction reference, if available.

7.2 Requesting from Devign29 or Paddle

Because Paddle.com is the Merchant of Record and seller (see Section 8), You may request a refund either from Devign29 at support@devign29.com or directly from Paddle. Devign29 does not receive or hold the purchase price and cannot pay a refund to Your card or other payment method directly.

7.3 Handling and payment

Devign29 will acknowledge Your request within a reasonable period and review it under this Policy and applicable law. Where a refund is due, Devign29 approves or forwards the eligible request, and Paddle processes the approved refund to the original payment method used for the purchase within 14 days of approval.

8.1 Role of Paddle

Purchases are processed by Paddle.com Market Limited / Paddle.com Inc. as Merchant of Record. Paddle issues the invoice or receipt and processes payments and refunds.

8.2 How refunds are returned

Because Paddle is the Merchant of Record and seller, Paddle — not Devign29 — issues refunds to the original payment method; Devign29 cannot pay a buyer's card or other payment method directly. Devign29 reviews and approves or forwards eligible requests, and Paddle processes the approved refund to the original payment method within 14 days of approval. The time for the refund to appear thereafter depends on the payment provider.

8.3 Paddle buyer support

Buyers may also contact Paddle buyer support for billing questions relating to their transaction.

Buyers are asked to contact Devign29 first before initiating a chargeback, so that the issue can be reviewed and resolved directly. In many cases a chargeback can be avoided by a prompt refund or correction where one is due under this Policy or applicable law. Because Paddle is the Merchant of Record and appears as the merchant on the card statement, card disputes, chargebacks, and representment are handled by Paddle; Devign29 will assist Paddle with the review as needed.
